    1. If you have a dispute with Maldives.com, in the first instance please contact us at the details given below and attempt to resolve the dispute with us informally.

    2. In the unlikely event that we are not able to resolve the dispute informally, we will discuss with you the most effective way of resolving the dispute using mediation or arbitration based on the nature of the dispute.

    3. You may also wish to refer to the EU online dispute resolution platform (ODR) by clicking here. This ODR platform is a means of registering your complaint with us; it will not determine how your complaint should be resolved.

    4. Please note that a failure to advise us/The Affiliate Partners of problems whilst on holiday, as described above, deprives both us and The Affiliate Partner of the opportunity to investigate and rectify your complaint whilst in resort and this may affect your rights under this contract including reducing any compensation due, potentially to zero.

  6. Insurance

    1. It is important that you have enough insurance in place to cover you (and your group) whilst you are away and it is a condition of your booking that you have such suitable insurance cover in place, as we do not process insurance claims. Please ensure that you have a valid travel insurance policy in place from the time of booking, to cover you for the duration of your holiday in The Maldives.

  7. Travel Information and Flights

    1. Arrival/Departure at Velana International Airport (VIA)

Velana International Airport is located on a separate island called Hulhule, a 10 minute boat ride from Male’, the capital island of Maldives. Owing to government legislation, every hotel/resort requires complete details of all Guests. If you wish a smooth check-in, please provide us with these details upon booking, so that we can arrange for pre-registration to save you time upon check-in at the resort. Kindly advise us prior to your arrival whether you are travelling with several pieces of luggage in order for us to arrange for your personal porter.

    2. Visa/Passport

In the vast majority of cases, you will receive a tourist visa valid for maximum 30 days upon arrival at Velana International Airport. Moreover, we will process any extension upon request subject to applicable visa fees as imposed by the government at the time. For your ultimate convenience your presence at respective authorities is therefore not required. Passports must be valid for the period of the intended stay. All visitors must hold tickets and documents for their return or onward journey upon entry to the Maldives.

    3. Import Legislation Upon Arrival

The following items are prohibited to be imported to the Republic of Maldives: pornographic literature, idols of worship, pork products and certain other animal products, explosives and weapons, alcoholic beverages. Please note: Drugs are strictly prohibited. The penalty for importing drugs for personal or other use is life imprisonment. Animals require a veterinary certificate, but pets are not accepted at the resorts. If possible, put all liquid items in your check-in baggage. This includes water and other drinks, creams, sprays, pastes and gels. In your hand luggage liquids, gels and aerosols are only allowed in individual containers of 100 ml, so that all containers will fit comfortably in one, transparent, re-sealable bag no larger than 20 cm x 20 cm (e.g. A freezer bag).

    4. Export Legislation Upon Departure

The following may not be exported in any form: tortoise and turtle shells and products made of turtle shell (the Government has banned the killing of turtles) and black coral in whole form.

    5. Hotel/Resort Voucher

The Affiliate Partner will issue you a confirmation email once the payment process has been verified and/or completed. This email should contain your payment details and Booking Reference. Keep the booking reference with you at all times as it will be used for identification by your Affiliate Partners. In order to guarantee easy access to your records during your stay, please so that you can present it during check-in at the resort.

  8. Transfers and Check-In / Check-Out Information

    1. Transfers To/From The Resorts

The Maldives archipelago is made up of about 1190 islands scattered across the Equator in the Indian Ocean. The capital island, Male’ is a short boat ride away from the main airport. The unique geography has led to the development of over 100 resorts, each on its own island, and a growing number of hotels and guest houses. The unique geography also presents unique challenges for transport within the islands. We depend on speedboats, seaplanes or domestic flights to bring you to your dream resort. The transfer modes to/from the resort islands and the duration of the transfers vary because of their respective distance to Velana International Airport (VIA), the main International Airport near Male’, and will be advised upon booking. We require your international flight details at least 7 days prior to arrival to organise the transfers accordingly. Below are the available transfer options in the Maldives.

    2. Private Transfer

If you book a private transfer (usually originating from/to the airport), you are not required to wait for other passengers or to stop along the way to drop off other guests Instead, you have immediate access to your private speedboat or seaplane according to your personal travel itinerary, all tailored to your specific needs. We recommend a private transfer; if you are staying at more than one resort, to save time by avoiding a trip to the main airport to change boats for the next destination Moreover, it will guarantee you maximum privacy and comfort. Your Affiliated Partner will be pleased to advise you on private transfer options and costs involved.

    3. Combined Transfer

Unless clearly stated otherwise, all transfers refer to combined transfers originating from or to the airport. Combined transfers normally accommodate a group of passengers arriving or departing at or around the same time. Therefore, combined transfers might include waiting time for other passengers who might be arriving on different flights, varying between few minutes and, very rarely, even hours. Kindly respect the scheduled, confirmed transfer timings. The resort reserves the right to book you on a later transfer (additional charges might apply) if you are not on time, since other passengers will be waiting. If there is no other combined transfer available later, you will have to wait (subject to availability at the time) and pay for a private transfer charged additionally. Furthermore, stop overs are sometimes necessary to pick up or drop off passengers at other islands along the route. The time of your departure from the resort will depend on the resort’s transfer departure schedule in line with international airline timings; the resort will inform you accordingly on the evening prior to your departure.

    4. Combined Speedboat

For many, the serene speedboat transfer over crystal clear water to the resort island is the first highlight of the holiday. The transfer time varies from 10 minutes to 2 hours, and bookings are subject to availability. Speedboats are equipped with sun roofs, the latest GPS navigation systems and life jackets. There are no luggage limitations and travelling at night is possible.

    5. Combined Seaplane

A quick and smooth way to travel, a seaplane transfer allows a unique way to see the beautiful azure panoramas of the Maldives from above. The seaplane, seating up to 15 passengers, does not travel during the night but normally from 6 am to 4 pm. Depending on the resort’s location the scenic flight takes between 15 minutes to 1 hour. The flight will either be direct or “hopping” between islands in an atoll (group of islands) to drop off or pick up passengers along the way. The maximum luggage allowance is usually 20 kg checked in and 5 kg hand luggage per person.

    6. Combined Domestic Flight

The air conditioned propeller airplanes used for domestic flights are bigger than the seaplanes, each seating 16 to 75 passengers. A domestic flight might be required to reach more secluded island resorts e.g. Island Hideaway. For example, it takes 50 minutes from Velana International Airport to Hanimadhoo Island Airport followed by a 20 minute speedboat transfer to the resort. The maximum luggage allowance is usually 20 kg checked in and 5 kg hand luggage per person.

  9. Resort Check-In / Check-Out Policies and Booking Amendments

    1. Resort Check-In/Check-Out

Check-in and check-out times are determined by the resort but, in general, check-in time is 14:00 hrs (2pm) and check-out time is at 12:00 noon. The actual times will be advised at the time of booking by The Affiliate Partners. It is not possible for the resort to confirm early check-in or late check-out in advance since this depends on availability (transfer timings of the in-house guests) on that particular day. The only way to guarantee early/immediate access to your room or to keep it longer on your departure day (according to your international flight timings) is to book the room one day in advance. Similarly, to avoid uncomfortable waiting times at the resort’s lobby or at the Airport, with limited or no access to rest or changing rooms especially, if you are travelling with children. Should you wish a guaranteed early check-in or late check-out, please let The Affiliate Partners know, so that arrangements can be made accordingly. Alternatively, you can request for an early check-in upon arrival and/or late check-out on the day of your departure directly at the resort which is then subject to availability at that time. The following charges will apply for late check-out:

    2. Late Check-Out Charges

To keep the room until 18.00 hours (6pm): 50% of the room rate (subject to availability at the time) To keep the room after 18.00 hours (6pm): 100% of the room rate (subject to availability at the time) Late check-out charges must be paid directly to the resort. If you require any assistance, then contact The Affiliate Partners looking after your booking.

    3. Early/Late Arrival and Departure Booking Amendments

Booking amendments depend on availability at the time. Any booking amendment will result various modifications; airport transfer, voucher and other documentary changes for example. For this reason, Affiliate Partners may charge an administration fee of USD 150 per change after receipt of booking confirmation at their discretion. This applies to any changes that affect arrival and departure dates, room types, number of persons or other administrative changes. Depending on the amendment details and fluctuating market prices these changes might result in higher booking costs than previously anticipated.

    4. Requests for Specific Room Number

The room allocation is a complex process, solely managed by the resort according to its internal procedures. We are therefore unable to guarantee allocation of a specific room or location. The Affiliate Partners will do their best to fulfil your request by directly contacting the resort. Please note that the earlier we are advised of any such special requirements, the greater the possibility of success.

  10. Health and Medical Services in The Maldives

    1. Health
If you have significant allergies or chronic medical problems, please inform your Affiliate Partners as soon as possible, prior to confirmation of the booking. Most resorts in the Maldives have a resident doctor that can provide limited medical services. In can you require medical attention and if the resort does not have its own doctor you will be taken to the nearest resort or habited island with a doctor with a doctor.
    2. Guests’ Who Require Mobility Assistance

Some resorts may not have the facilities to accommodate handicapped people, please check with your Affiliated Partner before confirming the booking. Please inform Them as soon as possible and not later than 7 days prior to your arrival, if you require a wheelchair or additional assistance upon your arrival/departure.

    3. Medical Facilities in The Maldives

In general, Maldives has reasonable medical services, pharmacies, a large government hospital and a smaller private hospital in the capital city of Male’ providing a broad range of medical services and catering for emergencies.

In the event of diving emergencies there are three decompression chamber facilities located around the Maldive islands, one at Bandos Resort (fifteen minutes by speedboat from Male’) and the other at Kuramathi Island Resort (one hour by speedboat and about twenty minutes by air taxi from Male’).

If you are on medication, please ensure to bring adequate supplies of all medications in their original containers, clearly labelled. We recommend carrying a signed, dated letter from your primary physician describing all medical conditions and listing all medications, including generic names. If carrying syringes or needles, please be sure to carry a physician’s letter documenting their medical necessity. Please pack all medications in hand luggage and carry a duplicate supply in the checked luggage. If you wear glasses or contact lenses, please bring an extra pair. Although yellow fever is not a disease risk in Maldives, the government requires Guests arriving from countries where yellow fever is present (Africa, Central and South America) to present proof of yellow fever vaccination. For current information please consult official resources such as the WHO (World Health Organization) website prior to travel. Please refrain from drinking tap water at the resort as it is not intended for drinking.

  11. Your Behaviour

    1. It is important that you behave responsibly and with consideration for others during your holiday. Accordingly, to the extent that one of our Affiliate Partners believes that your actions could or have caused disruption or annoyance, or a risk of safety, or damage to property, to us, The Affiliate Partners or other customers, or if it is believed that you are not fit to travel, then The Affiliate Partners may cancel your Booking (or we may cancel your Booking) without further liability to you. In these circumstances, the cancellation provisions of paragraphs 23, 24 & 25 below shall not apply.

    2. In the event that your behaviour causes loss or damage to any person or property for which we are liable, you agree to compensate us for such loss and damage, together with any legal costs which we may incur in pursuing this claim against you.

  12.  Events Outside Your Control

    1. In these Terms and Conditions, where we refer to “Unavoidable And Extraordinary Circumstances“, it means a situation beyond the control of the party who invokes such a situation and the consequences of which could not have been avoided even if all reasonable measures had been taken.

    2. This may cover for example warfare, other serious security problems such as terrorism, significant risks to human health such as the outbreak of a serious disease at the travel destination, or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the destination, as well as industrial disputes (whether or not involving our employees), or acts of local or central Government or of any other competent authorities.

    3. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a booking that is caused by any Unavoidable and Extraordinary Circumstances.

  13. Each of These Terms Operates Independently

    1.  Each of the paragraphs of these Terms and Conditions operates separately. If any court or any other relevant authority decides that any of these paragraphs (or any part therein) are unlawful or unenforceable, the remaining paragraphs (and parts therein) will remain in full force and effect.

  14. Entire Agreement

    1. These Terms and Conditions, your booking confirmation and the relevant Travel Affiliate Partner(s)’ terms and conditions set out the written terms of our contract with you for the provision of the Services. 1. We may modify or update these Terms and Conditions from time to time at our sole discretion and for reasons including (without limitation):

      (A) changes in how our business operates;

      (B) changes in the legal or regulatory requirements that we must comply with; or

      (C) changes in how we accept payment from you.

    2. We will notify you of any material changes to these Terms and Conditions either using the usual method of communication we use to contact you or using a notice on our website or app. For the avoidance of doubt, this does not apply to confirmed bookings.

  16. Rights of Third Parties

    1. Any contract made between you and us is only made between you and us. No third party will have any rights to enforce any of its terms.

  17. Transfer of Our Rights

    1. We may transfer our rights and obligations under our contract with you to another organisation, and we will do our best to notify you if this happens, but this will not affect your rights or our obligations under the contract.

  18. No Waiver

    1. If we do not insist immediately that you do anything you are required to do under these Terms and Conditions, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you immediately, we can still require you to make the payment at a later date.

  19. Maldives.com’s Role as an Online Marketplace for Affiliated Partners

    1. We act as an Online Marketplace for The Affiliate Partners whose travel packages are featured on the Services. This means that we act as an intermediary of The Affiliate Partners and provide a platform through which you can enter into a contract with The Affiliate Partners for the provision of the travel packages.

    2. For the avoidance of doubt, ‘travel packages’ includes the provision of package holidays and/or direct bookings, organised or combined by Affiliate Partners who have signed an agreement to partner with us. Maldives.com does not directly enter into a contract with you to provide Packaged Offers or Direct Bookings for you to purchase.

    3. We do not act as an agent for you in relation to negotiating or concluding any contract between you and any affiliate partner. Your contract for the travel package is with the affiliate partner. As such, these Terms and Conditions govern your use of our Services but the provision of the Travel packages you purchase will be subject to the terms and conditions displayed on the travel package page, any additional booking conditions made available to you just before you pay for a travel package through the Services and the terms and conditions of The Affiliate Partner (the “Offer T&Cs“).

    4. By using the Maldives.com to purchase a travel package from the affiliate partners, you agree to the Offer T&Cs and you agree that you are contracting directly with The Affiliate Partner in relation to the travel package purchased.

If, after purchasing a travel package, you have any queries or concerns about the Travel package, please contact The Affiliate Partner directly.

    6. As your contract for the travel package will be between you and The Affiliate Partner, we will not be in any way responsible for the delivery of the Packaged Offer. As such, we do not accept any responsibility or liability for any loss you suffer as a result of availing yourself of the Packaged Offer.

  20. Booking Travel Packages

    1. You can book travel packages from Affiliate Partners by following the process outlined in the Services. All bookings are subject to acceptance by The Affiliate Partners. A contract will only come into existence between you and The Affiliate Partner(s) when you have paid the price payable on booking and we have issued you with a booking confirmation on behalf of The Affiliate Partners. You acknowledge that by booking with an affiliate partner, you will be under an obligation to pay for the travel package booked by you. We will charge your chosen payment method after we accept your booking. The Affiliate Partner will send you a further email when your booking has been processed confirming the details of the travel package you booked, including all relevant confirmation documentation as may be required if you have booked a travel package with an affiliate partner.

    2. If we are unable to accept your booking because, for example, there are no more vacancies remaining on your chosen dates, or because of an error in the price we will inform you of this by email and we will not process your booking. If you have already paid for the Travel package (or any part of it) we will arrange for monies paid to be refunded to you in full as soon as possible.

    3. the booking process with the affiliate partner allows you to check and amend any errors before submitting your booking for a travel package. Please take the time to read and check your booking at each stage of the booking process.

    4. Please make sure that you (and any travel companions) are eligible for any travel package and are able to travel on the dates for which you have booked the travel package prior to making a booking.

    5. If you (or any travel companions) have any special requests you must let the affiliate partner know during the booking process. Maldives.com will pass all requests to The Affiliate Partners, but we cannot guarantee that such requests will be met by The Affiliate Partners. Maldives.com does not accept bookings that are conditional on the fulfilment of a special request.

    6. If you have a medical condition which may affect your booking, please let the affiliate partner know before making a booking so that the affiliate partner can find out if the travel package is suitable before you make a booking.

    7. You must keep the contact details we hold for you up-to-date so that either we or The Affiliate Partner can contact you if necessary, about your booking.

    8. Once your booking request has been accepted by The Affiliate Partner and this has been communicated to you by them, and you have paid for your travel package, an email booking confirmation will be sent via Maldives.com with the details of your booking for the travel package. This email confirms receipt of your booking and payment and contains all details of your travel package.

    9.  When you receive documentation for your travel package, please ensure you check that all personal details are correct and, in the event, that the travel package involves travelling abroad, that they match the names and ages on the passport(s). If this is not the case, please contact The Affiliate Partner as soon as possible.

    10. In the event that tickets and/or travel documents do not arrive by email, Maldives.com will not be responsible. Please contact The Affiliate Partner identified in the booking receipt email directly should you not receive these documents.

  21. Price of Travel Packages
    1. The price of any travel package will be as quoted with a starting price on the Services, except in cases of obvious error. The price of a travel package includes Tourist-Goods and Services Tax (T-GST), together with any other relevant taxes such as Bed Tax and Green Tax (where it applies).

    2. The advertised price of any Travel package may change from time to time and we will inform you of the actual price at the time of booking.

    3. Due to the large number of Packaged Offers or Direct Bookings on the Services, it is always possible that some of the Packaged Offers or Direct Bookings listed on the Services may be incorrectly priced, despite our reasonable efforts to make sure that they are accurately priced. We will normally verify prices with Affiliate Partners as part of our booking-handling procedure so that, where a Packaged Offer’s or Direct Booking’s correct price is less than the stated price, we will charge the lower amount when accepting the booking from you, as agent for The Affiliate Partner. If the Packaged Offer’s or Direct Booking ‘s correct price is higher than the price stated on the Services, normally, and at their discretion, either they will contact you for instructions before processing your booking, or reject your booking on behalf of The Affiliate Partner and notify you of the rejection.

    4. Please note that The Affiliate Partner is under no obligation to agree to supply the Travel package to you at the incorrect (lower) price, even after we have sent you a booking confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing.

  22. Payments for Travel Packages

    1. We act as a payment agent for The Affiliate Partner. We accept payment from you on behalf of The Affiliate Partner using the payment methods listed on the Services. You must pay for the Travel package by the date(s) set out in your booking confirmation. If any sum is not paid either partially or in full by the due date(s), The Affiliate Partner may cancel your booking and The Affiliate Partner may charge you a cancellation fee. If you have already made a payment to us in respect of that Affiliated Partner, we may on behalf of The Affiliate Partners deduct the cancellation fee from the payment already made to us before returning the balance to you or, where that payment is not sufficient to meet your liability to The Affiliate Partner, you agree to pay The Affiliate Partner the additional sum.

    2. By making a booking through the Services, you are confirming that the payment details provided on the booking are valid and correct. If any payment method is rejected, we may contact you requesting an alternative payment method, or we may cancel your booking.

    3. If you have any query about an amount that has been charged by us to your credit or debit card, please contact us straight away. In the event that we find a payment has been taken in error we will refund the amount immediately to your credit or debit card.

    4. Maldives.com acts solely as an Online Marketplace between the customer and The Affiliate Partners, and therefore cannot issue an invoice for a sale made by The Affiliate Partners. Maldives.com does provide a booking confirmation which can be used as a receipt as it shows the amount paid at the time of booking. Please Contact your Affiliated Partner to provide you with a tax invoice.

      (B) In the event the changes requested by the guest are not possible – The Affiliate Partner may offer the guest alternative arrangements, if the changes suggested are deemed unacceptable the guest may request a partial or full refund based on the how close the cancellation request was made to the dates of travel. If the guest is due to travel within 14 calendar dates of the cancellation request, they may only be entitled to a partial refund (depending on the Offers T&C’s) Maldives.com cannot process these requests, it is the Guest’s responsibility to contact the Affiliate Partner regarding any Amendments and Cancellations.

  24. Cancellations and Amendments by Affiliate Partners

    1. It is the Affiliate Partners responsibility to notify their guest of any changes to their purchased travel package. Most changes are minor changes, however, occasionally they may have to notify Guest’ of a significant change that they, have made to a purchased travel package. An example of a significant change is changing the travel dates or cancelling the travel package. The Affiliate Partner will contact you with the reasons why they have to make a significant change.

    2. In the unlikely event of an affiliate partner cancelling or making a significant change to your purchased travel package, they will inform you as soon as possible. If there is time to do so before the start of your purchased travel package, they will use reasonable efforts to seek (but cannot guarantee) to you of one of the following options (depending on the nature of the purchased travel package):

      (A) a choice of accepting an alternative reservation; or

      (B) cancelling your reservation together with a full refund of the fees which you have paid up to that point.

    3. Affiliate Partners may not give Guest’s any of the above options in the event that a change to the purchased Packaged Offer is a minor change. Please note that a change of flight time of less than 12 hours, a change of airline or aircraft (if identified at the time of booking) or a change of accommodation type to another of the same or higher standard usually qualify as minor changes.

    4. Where an Affiliate Partner cancels or makes changes to the purchased travel package, Maldives.com will not be responsible for any costs incurred by you.

    5. In the rare cases that an Affiliate Partner cancels your booking after it has been accepted, you will be notified by The Affiliate Partner or Maldives.com acting on The Affiliate Partner’s behalf.
